IP Law Concentration: Podcast

     A full time law professor and formal engineer, Andrew Beckerman talks about intellectual products.  He refers to intellectual products as those products of the mind.  Not physical tangible items but items such as trademarks, or copyrights for songs.  Intellectual property laws are the bodies of law that protect these things.  He breaks down the individual types of IP law. 

     Beckerman talks about Patents and breaks them down into two categories.  The first type of patent is a utility patent. 

     The second type of Patent is a design patent, which protects the aesthetic appearance of a functional object.  Companies like apple have been after other companies who do not respect their patent on their packaging of computers.  He explains how patents were designed to protect the public.  Patents also require the product to be new it cannot be something that has previously been invented. 

Is Neutrality a Virtual Taking: Podcast

     Professor Daniel Lyons who has a degree from Harvard law school gives us the run down on net neutrality.  The 5th amendment regulates broadband providers and Lyons will discuss this issue.  He uses Costco, a well-known bulk wholesaler to illustrate his case.  Costco only gives shelf space to top brand names.  This is unfair to consumer and off brands because they must purchase certain brands in bulk and there are not large varieties. 

     Net neutrality is about regulating the “on ramp” of the Internet.  Referring the Internet to a super highway.  Wiring is placed underground to keep everyone connected around the world.  In order for a household or a business to take part in this a monthly fee is charged.  It states that large ISP’s such as Time Warner cannot stop the flow of content through the Internet they are providing. 

     He used Comcast as an example they tried to monitor the use of the Internet by Bit-Torrent users.  This causes issues and the FCC got involved and a case came about.  Comcast was accused of violating certain jurisdictions outlined in the law. 

The Myriad Case

     A pending case in New York and referencing gene related patent items.  This is rather interesting because this is not a classic situation and I am wondering what exactly brought this about.  Objects like gene sequences were patented and tested right before our eyes.  This is interesting because something so intimate and private has to be patented.  Is this considered intellectual property?  Are these items eligible to be patents?
